INDRA REHAB FRAUD: LAWYERS AMONG 5 HELD

The district police here have arrested five more persons in connection with fraudulent transactions in payment of rehabilitation and resettlement (R&R) assistance to fake displaced persons (DP) of Lower Indra Irrigation Project (LIIP), raising the total number of arrested persons to 13.
Two of the arrested persons this time are senior advocates and notary public of the district — Nirmaya Ranjan Pattanaik of Komna and Dinesh Tiwari of Khariar. They, with other persons, were booked under Sections 419, 420, 120(B) 468 and 471 of the IPC. As the bail plea of the arrested persons was rejected in the SDJM court, the accused were sent to jail custody.
Meanwhile, the police are in search of four more advocates who are also suspected to be party to the signing of false affidavits. In a big shot to their arm, the police arrested the kingpin of the transaction Balabhadra Parabhoe, who was absconding for last two months.
The arrests of the advocates were carried out on the basis of an FIR dated August 23 last filed by Land Acquisition Officer (LAO) of LIIP, Durbadal Meher, where the officer had mentioned that more than Rs 23 lakh was misappropriated through 11 cases of fraudulent transactions.
Although the names of the advocates or the notary did not figure in the FIR of the LAO, the police implicated them in the case through subsequent investigations and recording of statements of the witnesses and accused persons under Section161 of CrPC.
Through the investigation, the police have found that Hadu Patel, Dinabandhu Patel, Ramani Patel and Surendra Majhi are non-existent names in Haripur village, but some other persons presenting themselves against the names signed affidavits and produced other necessary documents and availed the R&R assistance of more than Rs 2 lakh each.
Two advocates, Narendra Meher and Suresh Agrawal identified the fake people as real DPs and the Notary Public Dinesh Tiwary attested the affidavits of the fake persons.
Five other persons of Mathiapadar village of Komna block signed the affidavits in the name of five non-existent persons named Birji Karua, Sadananda Karua, Bashudev Karua, Mahendra Karua, which have been attested by the Notary Public Nirmaya Pattnaik. Likewise, Public Notary Siba Meher attested the affidavits of Ujal Rana, Benudhar Majhi, Parsu Majhi, Lalit Majhi and Chandra Majhi who are non-existent persons in Pendrawan village. These fake DPs took identification from advocate Sanjaya Meher. Both the advocates and the Notary Public are absconding and the police are in search of them.
“The arrest of the Notary Publics and the advocates is totally illegal, because they have attested the affidavits on the basis of the documents produced before them by the deponents,” said Joint Secretary of the Khariar Bar Association Chitta Ranjan Sing Deo. “There is a judgment of the Bombay High Court in 2003 in this regard, which states that the advocates and the Notary Publics attest the affidavits on the basis of the information and documents placed by the deponents in front of them,” added Deo.
The advocates of two bar associations of the district had met the district police superintendent to express their concern on the excesses of the police. “The SP has assured us that he would look into the matter with utmost urgency, the advocates said.
