NBWS ISSUED AGAINST 3 N’PADA FOREST STAFF

The Judicial Magistrate First Class (JMFC), Khariar issued non-bailable warrants (NBWs) against three officials of Forest (Territorial) Division of Khariar. The NBWs were issued against DFO Sarat Chandra Panda, ACF Nityanand Naik and Forester Surendra Barik for deliberately defying summons of the JMFC for appearance in the court. The police are yet to arrest the officials, as they are absconding.
The incident which led to such an unprecedented situation is peculiar. The DFO had issued an order for digging of a trench on the boundary line of forest land located near the JMFC court. The work resulted in the damage of a footpath and the water supply system leading to the court premises. Expressing discontent, the advocates of Khariar Bar Association requested the Forest Department to stop the work.
However, the DFO instead of listening to them, justified his work stating that the land belongs to his department and he cannot be dragged to the court for performing his duty.  Consequently, the Bar Association decided to approach the court and a complaint case was filed by Khariar Bar Association president Aprameya Panda on March 11 last in the court of JMFC under section 3(2) of Destruction of Public Properties Act and Sec 506 and 34 of the IPC.
The court issued summons on April 6 last to the opposite parties for appearance through their pleaders. Consequent upon the non-appearance of the forest officials in the court, the JMFC issued warrant for their personal appearance. Meanwhile, the Bar Association demanded immediate execution of the court order.
